How can a foreign legal entity launch a lawsuit in courts of Iran?
Under Article 144 of the Civil Procedure Code of the public Courts, foreign legal entities have the right to launch a lawsuit in Iran courts.
In some cases, on request of Iranian party, they are required to pay a sum to the court’s fund As Possible Damage. If they win the lawsuit, this amount will be refunded to them. If they convicted in the lawsuit, In case of damage to Iranian side, the court compensates it from the money paid to the fund.
Only a person with authorized signatures in the company or his/her lawyer has the right to file a lawsuit.
The petition must be fully set up in Farsi.
The name, registration number of the company and its address must be entered in the petition.
The name, registration number of the opposite party and its address must be entered in the petition.
If the opposite party is a true person, his/her first name, last name, father’s name and address must be entered in the petition.
Company registration document and Verified copy of the document to the number of opposite parties plus 1;
The documents represent the person’s position in the company (the person who wants to file a lawsuit);
The official newspaper indicates the registration of the company if it exists;
Power of attorney, if the lawsuit is filed by a lawyer;
The documents represent your rightfulness and Verified copy of the documents to the number of opposite parties plus 1;
You should go to the Judicial Services Office and file your lawsuit.
